Gabe’s practice focuses on complex civil litigation.  Gabe has handled a wide variety of commercial litigation matters, including breach of contract, conversion, breach of fiduciary duty, trademark, administrative review, consumer protection, ERISA, Fair Labor Standards Act, and probate.  

Gabe also has experience with bankruptcy litigation and has represented trustees and creditors in various matters, including exemptions, preferential and fraudulent transfers, objections to discharge and the dischargeability of debt, equitable and conventional subrogation, and the assumption and rejection of leases. 

Gabe’s recent representations have included:

  • Members of a start-up Bitcoin company in action against member for breach of duty of loyalty.  Obtained a temporary restraining order against member and ultimately secured control of the company for the remaining members.
  • Municipal debt collection company in breach of contract action against subcontractor which had attempted to usurp the company’s contracts.  Obtained a preliminary injunction against subcontractor that lead to a successful settlement.
  • Municipality in bankruptcy proceeding challenging the assumption and assignment of an exclusive gaming license which ultimately lead to a favorable settlement for the municipality.
  • Foreign based polymer company in prosecution of trade secret, covenant-not-to-compete and non-solicitation litigation against former executives who formed new competing company. Obtained a preliminary injunction which lead to a favorable settlement.

Prior to joining Calfo Eakes & Ostrovsky, Gabe served as law clerk for Chief Judge Brian D. Lynch for the United States Bankruptcy Court for the Western District of Washington from 2016 to 2018.  Before the clerkship, Gabe practiced in Chicago at Shefsky & Froelich Ltd., and then later Taft Stettinius & Hollister LLP, which merged with Shefsky & Froelich Ltd. in 2014.  Gabe focused on commercial and bankruptcy litigation while at Shefsky and Taft.  Prior to working at Shefsky, Gabe practiced in the bankruptcy department at Jenner & Block LLP in Chicago, where he worked on various corporate reorganizations and bankruptcy litigation matters.

Gabe’s pro bono work includes working with Northwestern University School of Law’s Bluhm Legal Clinic on the preparation of a death row inmate’s post-conviction petition.  The client’s sentence was eventually commuted and he was ultimately released from prison.  Gabe has also provided pro bono representation for victims of domestic violence, elderly individuals seeking bankruptcy relief, and for a no-kill animal shelter.
